Anyone who has been keeping up with Nintendo news over the past year or so can attest that the lead-up to the Nintendo Switch 2 has been a wild ride. For the longest time fans were eagerly looking for any news or rumors related to the system, and any insider news that slipped out gained immense traction. As such, leaks from all sorts of sources abounded, including the known accessory manufacturer Genki who went as far as showing off a model of the system at the Consumer Electronics Showcase (CES). That bold marketing move has backfired on them now, as Nintendo are now filing a lawsuit in response.
The documents were first spotted by OatmealDome on Bluesky, in which the case against Genki is fully laid out. Nintendo claims action for trademark infringement, unfair competition, and false advertising from Genki leading up to the system’s reveal. Genki began claiming to have access to the Nintendo Switch 2 as early as January of 2025, and started marketing accessories for the system to gain traction from the eager fanbase. Nintendo itself claimed not to have given Genki access to the system, and Genki itself would later claim to have never had one as well.

Whether Genki did have a mockup of the Switch 2 or not, it would have either had to obtain one through illicit means or were falsely advertising their accessories from the start. Either way, it doesn’t look like they’ll be getting out of this without repercussions in some way. Only time will tell what will happen to the company as the Switch 2 prepares to make its debut next month.
