Roughly one year ago, we reported on a lawsuit Nintendo had filed against the streamer Jesse Keighin, aka EveryGameGuru. At the time, Nintendo alleged that Keighin had been streaming pre-release and pirated versions of Nintendo software on his Twitch channel. The company sent all manner of cease and desist letters and even DMCA shutdowns before resorting to legal action. After going to trial this past year, the court has awarded Nintendo the win to the tune of $17,500 in damages.
As reported by Torrent Freak, Nintendo won its lawsuit in early October 2025. After going to federal court in Colorado, it appears as if Keighin failed to defend the case against him. He has been ordered to pay $17,500 in damages to Nintendo, though was given a reprieve from future infringement. The court denied a request from Nintendo to have Keighin “destroy all circumvention devices,” which the judge claimed was “unclear” and “unreasonable.” It also denied the request for an injunction against “third parties” since Nintendo could not reliably specify which third parties worked with Keighin.
While there is maybe a defense Keighin could have made had he found a lawyer, Nintendo likely would have drawn the case out in arbitration for the win regardless. Nintendo is orders of magnitude larger than any one individual and while using emulation isn’t illegal in and of itself, pirating unreleased games is. There is likely no way Keighin would have ever won this.
